Welcome to SellQuick. These Terms & Conditions ("Terms") govern your access and use of our website and services where we purchase, inspect and pay for second-hand goods. By using our site or submitting an item for an offer you agree to these Terms. If you do not accept these Terms, please do not use the site.

Definitions

“SellQuick”, “we”, “us”, “our” means SellQuick (the company operating the website). “You” means the person submitting an item or using the site. “Offer” means a price we give you subject to verification and inspection.

1. Eligibility

By submitting an item you confirm you are at least 18 years old (or the legal age in your jurisdiction) and you have the legal right to sell the item. You further confirm the item is not stolen, counterfeit or subject to any lien or encumbrance.

2. Offers, estimates & inspection

Our website provides estimates or offers based on the information and photos you supply. All offers are subject to inspection. We reserve the right to revise or withdraw an offer after inspection if the item's condition, serial number, accessories or ownership documentation differ from what was submitted.

• An offer is valid for the period stated in the offer (if any). If no period is specified, offers may be withdrawn at any time prior to acceptance.
• You may accept or decline a revised offer at inspection; if you decline, the item will be returned to you (if collection has not already occurred) or we will follow the return process described in our policies.

3. Pricing, fees & payouts

Our offers are net of any SellQuick fees or margins which are applied to cover logistics, inspection, refurbishment and operating costs. Payouts are generally made by EFT to the bank account you provide, subject to successful verification. Processing times may vary by bank; we aim to process payouts promptly following acceptance and inspection.

4. Pickup, delivery & risk

When pickup is arranged, risk of loss or damage to the item remains with you until the carrier collects the item unless otherwise stated. For drop-off options, risk passes on acceptance at our partner location. We recommend packaging items carefully for collection.

5. Ownership & proof of title

You warrant that you are the rightful owner of the item and have the right to sell it. For certain items we may require proof of purchase, serial numbers, or identity documents. We reserve the right to refuse items where title cannot be proven.

6. Prohibited items

We will not accept illegal, stolen, hazardous, or prohibited items. This includes (but is not limited to) weapons, controlled substances, items lacking clear title, or goods that violate local laws. If such items are discovered, we will notify authorities where required.

7. Your obligations

• Provide accurate item descriptions, condition details and photos.
• Disclose faults, repairs, modifications, or damage.
• Provide valid bank details for payments and any documentation requested for verification.

8. SellQuick rights

We may: (a) refuse offers for any reason; (b) revise offers after inspection; (c) suspend or terminate accounts that breach these Terms; (d) use third parties (couriers, forensic/authentication partners) to perform services on our behalf.

9. Returns, cancellations & refunds

Unless otherwise agreed, once an offer is accepted and the item is collected and paid for, the sale is final. If inspection reveals material misrepresentation and we cannot agree on a revised offer, we will either return the item or follow the mutually agreed return/cancellation policy. Refunds (where applicable) will be processed within a reasonable time frame.

10. Intellectual property

All content on the site (text, logos, images, software) is owned or licensed by SellQuick. You may not reproduce or use our trademarks or content without our prior written consent.

11. Privacy & data protection

We process personal data as described in our Privacy Policy. By using our services you consent to processing in accordance with that policy.

12. Disclaimers

To the maximum extent permitted by law, our services and offers are provided "as is" and SellQuick disclaims all warranties, whether express or implied, including merchantability, fitness for purpose, and non-infringement. Prices and offers are subject to availability and change.

13. Limitation of liability

Except where prohibited by law, SellQuick’s total liability to you for any claim arising under or in connection with these Terms or our services shall be limited to the value of the specific transaction giving rise to the claim. We are not liable for indirect, consequential, lost profits, or punitive damages.

14. Indemnity

You agree to indemnify and hold SellQuick and its affiliates harmless from any claims, losses, liabilities or expenses (including legal fees) arising from your breach of these Terms or from your negligence, fraud, or misrepresentation.

15. Termination

We may suspend or terminate your access to services at any time where you breach these Terms or where required for operational, legal or security reasons. Termination does not affect rights and obligations that arose prior to termination.

16. Force majeure

SellQuick is not liable for any failure to perform due to events beyond our reasonable control (natural disasters, strikes, pandemics, government actions, or internet/service outages). Performance times may be extended accordingly.

17. Changes to Terms

We may update these Terms from time to time. Material changes will be posted with an updated "Last updated" date. Continued use after changes indicates acceptance of the updated Terms.

18. Governing law & disputes

These Terms are governed by the laws of South Africa (unless you and we agree otherwise). Any disputes will be subject to the exclusive jurisdiction of the courts of South Africa, to the extent permitted by law. Where applicable, we will attempt to resolve disputes informally before commencing legal action.

19. General provisions

• Severability: If a court finds any provision invalid, the remainder of the Terms remain in effect.
• Entire agreement: These Terms and the Privacy Policy constitute the entire agreement between you and SellQuick in relation to their subject matter.
• Assignment: We may assign rights and obligations under these Terms to a successor or related party; you may not assign your rights without our consent.
